近日，国务院印发《全面对接国际高标准经贸规则推进中国（上海）自由贸易试验区高水平制度型开放总体方案》（以下简称《方案》），提出了=#FF0000>15项政府采购领域改革举措，推动中国（上海）自由贸易试验区（以下简称上海自贸试验区）接轨国际通行规则，进一步优化采购程序，完善采购管理，加强采购监督，构建规范透明、科学严密的政府采购管理体系。

　　在采购程序方面，《方案》提出，在上海自贸试验区进行的政府采购一般应实行公开竞争。对以下情形，可采用单一来源方式采购：无投标、无合格投标、无合格供应商或存在串通投标；只能由特定供应商提供；为保持技术一致性或避免重新采购，对原采购补充采购；有限试用或委托研发的首创性货物及服务；发生不可预见的紧急情况，不能从其他供应商处采购等。政府采购实行有限竞争时，采购人应发布包括采购人信息、采购说明、资格要求等充分信息的资格预审公告，邀请供应商提交资格预审申请文件。如采购人有意选择有限数量的合格供应商投标，需说明相应选择标准和数量限额。政府采购实施邀请招标时，采购人应提前发布相关信息。开展200万元以上的货物、服务采购或5000万元以上的工程采购，采用邀请招标方式的采购人应设定提交资格预审申请文件的最后日期，一般应自资格预审文件发出之日起不少于25日，紧急情况下不少于=#FF0000>10日。政府采购实施招标时，采购人设定提交投标文件的最后日期，一般应自招标文件发出之日起不少于40日。符合特殊情形的，可以适当缩短期限，但不得少于=#FF0000>10日。
　　针对采购管理，《方案》规定，采购人编制政府采购预算时，应充分考虑以下因素：各类费用、佣金、利息等；选择性购买的价格；同一采购项下的所有合同。尽可能免费向供应商提供招标文件，并鼓励以中英两种语言发布采购公告。采购人有证据证明有关供应商在参与政府采购活动前3年内，履行与采购人或与采购人存在管理关系单位的采购合同时，发生过重大实质性违约且未及时采取合理补救措施的，可以拒绝其参与采购活动，但应当在采购文件中载明。采购人在编制政府采购需求时可以设置关于环境保护以及信息保护的技术要求。应未中标、成交供应商请求，采购人应向其答复未中标、成交的理由或中标、成交供应商的优势说明，答复内容不得涉及商业秘密。提升政府采购电子化采购平台的数字技术应用水平，推动采购流程透明化、规范化和智能化，推进电子证照应用。政府采购应便于中小企业参与，鼓励通过电子化方式进行采购。根据采购的规模、设计和结构，可对中小企业实施合同分包。
　　《方案》还对采购监督做了进一步要求，其中提出，指定独立于采购人的审查主管机关，就供应商对政府采购活动提出的投诉进行审查。鼓励采购人和供应商通过磋商解决投诉。供应商认为政府采购文件、采购过程和中标结果、成交结果使自身权益受到损害的，可以在知道或应知道其权益受到损害之日起=#FF0000>10日内，以书面方式向采购人提出质疑。
